Abstract

The process of drafting the “Criminal Law on Domestic Violence” (KDRT) is an evolution of the Criminal Code. Based on domestic violence is a special crime that is determined in addition to the Criminal Code. as Article 28G paragraph (1) of the Second Amendment to the 1945 Constitution stipulates that: "Every person has the right to protection for himself, his family, honor, dignity and property under their control, and has the right to feel safe and protected from threats of fear of doing or not doing something is a human right.” Hermien Hadiati Koeswadji, said that several criminal acts are regulated by special external regulations of the Criminal Code which are defined as special criminal laws.Criminal acts have their own characteristics, which lie in a particular subject, namely the perpetrator and the victim.This research was conducted using empirical normative research methods combined with literature study. (Libery Research) and field study research. Legal research serves to recognize law in a practical sense and examines how law works in society. The analytical technique used is a standard descriptive approach and is combined with facts and events observed in the field, especially those related to upholding regulations on domestic violence Domestic Violence (KDRT) is an act of physical, psychological, sexual or economic violence perpetrated by a family member against another family member. Domestic violence can occur in a husband-wife relationship, parent-child relationship or relationships between other family members. Domestic violence is a serious human rights violation and can have long-term negative consequences for victims. 23 2004 relating to the elimination of domestic violence, but effective law enforcement cannot be carried out properly when there is no sense of the overall participation of elements of society in dealing with domestic violence
