PERAN BADAN PERTANAHAN NASIONAL KABUPATEN MAMUJU DALAM PENYELESAIAN SENGKETA TANAH

Abstract


The function of land cannot be separated from the role of humans in utilizing it.The people of Mamuju, West Sulawesi as an agrarian society live byways of farming both farming, gardening and ponds. There is a shiftthe function of land is one of the causes of land disputes, soThe central government as well as local governments must seriously regulate a systemlaw on existing land, as well as the handling of settlements againstland disputes conducted by the National Land Agency(BPN) which occurred in Mamuju Regency, West Sulawesi Province. ByTherefore, it is necessary to know the role of BPN Mamuju Regency in dealing with itland dispute. As an attempt by the author to find the data used forcompiling the thesis, the authors use empirical research methods. StudyEmpirical is research that discusses how the lawoperate in society. As for the type of data that uses the author onthis writing, namely primary data derived from related respondentswith the title of this writing and then combined with the secondary materialis a statutory provision relating to this writing,such as the 1945 Constitution, Government Regulation Number 24 of 1997concerning Land Registration and Regulations of the Head of the National Land AgencyNumber 11 of 2016 concerning Settlement of Land Cases. As for locationinterviews devoted to research in this writing were conducted inMamuju District. It should be noted that the position of BPN is an institutionnon-ministerial government responsible to the President. So thatThrough this, BPN is given the authority to carry out the taskgovernance in the field of land as well as handling land disputes.Based on this description, it can be concluded that the Regency BPNMamuju is a legal entity engaged in the field of land andhas the authority to carry out governmental tasks in the field ofland rights and also given the authority to handle disputesland in Mamuju Regency. Given that there are still many disputesland in Mamuju Regency, therefore the authors suggest thatBPN Mamuju Regency further optimizes its performance in terms ofadministrative.
