KEDUDUKAN DAN PERLINDUNGAN KORBAN DALAM KASUS TRAGEDI KANJURUHAN DALAM PERSPEKTIF HAK ASASI MANUSIA

Abstract


Human rights regulate the relationship between individuals and the state that provide moral and legal protection to every human being in controlling and encouraging rules and practices of respecting power, ensuring individual freedom in dealing with the state and asking the state to carry out the fulfillment of human rights. individual basis within its jurisdiction. When the state is unable to protect and respect the human rights of individuals, human rights violations occur, one of the human rights violations that occurs is the Kanjuruhan Tragedy Case. That this tragedy caused 135 people to die as a result of the repressive actions taken by the police in securing football matches. Other victims were 596 lightly injured and 26 victims seriously injured, bringing the total number of victims to 757 people. Until today this form of protection has not been fulfilled by the state. The judicial efforts that were carried out seemed rushed and did not prioritize the interests and justice for the victims. So this paper discusses how the position and protection of the victims of the Kanjuruhan tragedy are viewed from a human rights perspective. The results of this study conclude that: first, the kanjuruhan tragedy is a case of gross human rights violations committed by the state through its institution, namely the police. Second, compensation can be a form of protection and fulfillment of victims' rights through authorized state institutions.
