Abstract


This research examines the implementation of regulations in Indonesia that adopted children can obtain inheritance from their adoptive parents through a mandatory will as regulated in article 209 of the Compilation of Islamic Law (KHI), however, in the distribution process and practice there is still uncertainty regarding regulations that accommodate, in In this case, the role of the judge in assisting through court decisions is very much needed, as the judge who made the decision referred to the provisions in Article 209 KHI, namely giving the adoptive child and adoptive parents the obligatory portion of their will, a maximum of 1/3 of the assets. inheritance, this has been implemented in decision Number 0973/Pdt.P./2016/Pa.Kab.Mlg. However, in this case each judge's decision can be different because it is tailored to the case at hand.
