PENEGAKAN HUKUM BERKEADILAN DALAM RANGKA MEWUJUDKAN PEMBANGUNAN NASIONAL DI INDONESIA DITINJAU DARI PERSPEKTIF TEORI KONTRAK SOSIAL

Abstract

Law enforcement in Indonesia is certainly an important part of the legal system
in Indonesia. Realizing a just enforcement certainly supports aspects of national
development. The approach in realizing law enforcement that has a sense of justice
can be seen from the perspective of social contracts. Seen from the perspective of
social contract theory, because this theory is very related to society where it cannot be
separated from the Indonesian people themselves who are the subject of the
realization of fair law enforcement that can synergize with national development. The
method used in this study uses a normative method of literature study with qualitative
descriptive. The results obtained to answer the topic in this study are bisal seen from
the perspective of social contract theory, of course this national development is
supported by the formation of laws that cover all elements of society, all elements of
Indonesian citizens have the right and obligation to create fair law enforcement and
also in accordance with the ideals of the Indonesian nation. Thus, fair law enforcement
seen with the theory of social contracts will be closely related to the aspirations of
Indonesian citizens to realize fair law enforcement which of course is for sustainable
national development, of course this long-term effect is very much needed because
good development is development that can be felt not only for the current generation,
but also for future generations.
