Abstract

There are rules governing the Separation of Property Agreement that can be made either before the marriage or during the marriage. As in the Marriage Law in conjunction with Constitutional Court Decision Number 69/PUU-XII/2015. The rule separates the binding responsibilities regarding joint property obtained during the marriage bond. The Separation of Property Agreement can be a preventive measure to prevent the involvement of the Marital Partners Property in the Bankruptcy Case. With the Separation of Property Agreement, the responsibility for the personal property has implications for each individual. Thus, the existence of a Separation of Property Agreement before the Bankruptcy Declaration Decision will be able to save the Debtor Partner's Property from being dragged into the Bankruptcy Case.
