IMPLEMENTASI HAK ATAS TANAH DALAM PROYEK STRATEGIS NASIONAL: STUDI KASUS PEMBEBASAN LAHAN UNTUK TOL CISUMDAWU

Abstract

The development of national strategic projects, such as the Cisumdawu Toll Road, often
involves land acquisition that presents challenges regarding the implementation of land
rights. This study aims to analyze the land acquisition process in the project and the
resulting social impacts. Using a normative juridical approach, this research assesses
the legal policies applied in the land acquisition process, identifies social disparities, and
explores efforts to reduce injustices. The study finds that although there is a clear legal
framework, the implementation on the ground often does not align with community
expectations. Lack of transparency, unfair compensation, and insufficient community
participation lead to social tensions. Therefore, the study suggests the importance of
synergy between legal and social approaches to achieve fair and sustainable
development. A more inclusive and participatory development process is necessary for
national strategic projects to proceed without generating social conflicts.
